Assumption of Risk, Release of Liability, and Participation Agreement

Guided RC Trail Adventures

Please read this agreement carefully before participating.

By participating in a Guided RC Trail Adventure organized by Take The Wheel RC LLC ("Company"), I acknowledge and agree to the following:

Voluntary Participation

I am voluntarily participating in this activity and understand that it involves walking on natural terrain while operating or accompanying radio-controlled vehicles.

Health and Safety

I understand that participation may involve inherent risks, including but not limited to:

• Slips, trips, and falls

• Uneven ground, rocks, roots, mud, loose gravel, and steep terrain

• Exposure to insects, wildlife, poison ivy, pollen, and changing weather conditions

• Minor cuts, scrapes, bruises, sprains, or other injuries

• Damage to personal property, including RC vehicles, electronics, cameras, or other equipment

• Accidental contact with other participants or RC vehicles

I understand that these risks cannot be completely eliminated and voluntarily assume all known and unknown risks associated with participation.

I certify that I am physically able to participate in this activity and will notify the guide if I have any condition that could affect my safety or the safety of others.

I agree to stop participating if I feel unsafe or am instructed to do so by the event guide.

RC Vehicle Responsibility

If I bring my own RC vehicle, I am solely responsible for its operation, maintenance, batteries, and condition.

If I rent equipment from Take The Wheel RC LLC, I agree to use it responsibly and return it in substantially the same condition, allowing for normal wear and tear. I understand that I may be responsible for damage resulting from intentional misuse, reckless operation, or failure to follow instructions.

Rules and Instructions

I agree to:

• Follow all instructions provided by the guide.

• Stay with the designated group unless instructed otherwise.

• Respect the environment and other trail users.

• Operate RC vehicles safely and courteously.

• Avoid disturbing wildlife or damaging vegetation.

• Follow all applicable park or property rules.

Failure to follow these rules may result in removal from the activity without refund.

Release of Liability

To the fullest extent permitted by law, I release and hold harmless Take The Wheel RC LLC, its owner, employees, volunteers, contractors, agents, and affiliates from any claims, demands, causes of action, damages, losses, costs, or expenses arising out of or related to my participation, except where caused by gross negligence or willful misconduct as provided by applicable law.

Indemnification

I agree to be responsible for my own actions and agree to indemnify and hold harmless Take The Wheel RC LLC from claims arising from my negligent or intentional acts during the activity, to the extent permitted by law.

Emergency Medical Care

If I become injured or ill during the activity, I authorize the event staff to seek emergency medical assistance on my behalf if I am unable to do so. I understand that I am responsible for any medical expenses incurred.

Photography and Video

I understand that photographs or video may be taken during events for promotional purposes. You can Opt in or out on through the form.

Minors

Participants under 18 years of age must have this agreement signed by a parent or legal guardian.

The parent or guardian acknowledges the risks described above and gives permission for the minor to participate. Minors must be accompanied by an adult. (adult does not have to rent and drive a car.)

Governing Law

This agreement shall be governed by the laws of the Commonwealth of Massachusetts.
